These terms of use (“Terms”) govern the use of the LeMoove app for iPhone and Android, the trackers and devices connected to it, this website (lemoove.com) and related services, together called the “Service”.
“LeMoove”, “we”, “us” and “our” refer to LeMoove, operated by NAS SOFTWARE, Brazilian company registration (CNPJ) No. 45.911.457/0001-96, based in São Paulo, Brazil, which is responsible for the Service. “You” means anyone who uses the Service.
By creating an account, signing in to the app or using the Service, you confirm that you have read and agree to these Terms and to the privacy policy. If you don’t agree, don’t use the Service.
What LeMoove is
LeMoove is a location-sharing service for people who know each other, like families and friends, organized into groups. Depending on the plan and the app version, it offers:
- real-time location of the people in the group, with battery and time at each place;
- place alerts, which tell you when someone arrives at or leaves a place;
- automatic alerts for trips, speed, battery, inactivity, missing location and proximity;
- an SOS button, which sends a call for help with your location to the people in your groups;
- trip history, stops and a driving report;
- chat and voice and video calls;
- GPS trackers for vehicles and Bluetooth tags for items.
What each plan includes is described on the plans page and on the app’s plans screen. Features marked “next version” aren’t available yet.
Who can use it
To create an account, you must have the legal capacity to accept these Terms.
Children and teenagers may use LeMoove with the involvement and authorization of at least one parent or legal guardian, who accepts these Terms on their behalf and supervises the use. The guardian is responsible for the use of the Service by the child or teenager in their care.
Your account
- You can sign in with email and password, a Google account or Apple.
- Account information must be truthful and kept up to date.
- The account is personal and non-transferable. Don’t create accounts on behalf of someone else without authorization, or use someone else’s account.
- You’re responsible for keeping your password and phone secure and for actions taken on your account. If you suspect unauthorized access, change your password and contact support.
Consent and responsible use of location
A person’s location is sensitive information about their life. That’s why this is the most important rule in these Terms:
Only use LeMoove to share location with people who know about it and have agreed.
The Service itself was built this way: each person installs the app on their own phone, joins the group with an invite code and allows location in the system settings. You agree not to get around this model. For example, you must not:
- install or set up LeMoove on another person’s phone without their knowledge and agreement;
- hide the app, its notifications or location permissions from the person being followed;
- use the Service to stalk, intimidate, threaten, control or monitor anyone;
- install a tracker in another person’s vehicle or belongings without authorization.
Stalking is a crime in Brazil (art. 147-A of the Penal Code) and in many other countries, and secretly following someone may violate privacy and other laws. If there are signs of misuse, we may suspend or close accounts, preserve information and cooperate with authorities, as permitted by law.
Parents and guardians who use LeMoove with children and teenagers should do so openly, explaining what is shared and why.
If you think you’re being followed without your knowledge, see the support center.
Groups and invites
- Whoever creates a group is its admin: only the admin shares the invite and deletes the group.
- The invite code stays active for 2 days. Only share it with people who should join the group.
- Group members see the location, trips and battery of the other members. Any member can leave the group at any time, and then stops seeing and being seen.
- The number of groups and places depends on the plan.
How location works, and its limits
The location shown by LeMoove is an estimate calculated by the phone or tracker using GPS, Wi-Fi and the cellular network. It depends on factors outside our control, such as:
- the permissions granted and the phone’s battery-saving settings;
- GPS, internet and cellular signal;
- the phone being on, charged and free of system restrictions;
- the behavior of each manufacturer and system version.
That’s why positions, trips, arrival and departure alerts and other alerts may be delayed, inaccurate or not happen at all. A phone that isn’t moving may go a while without sending its position: that’s normal and saves battery.
Using location in the background consumes battery. LeMoove uses motion sensors to reduce this, but the impact varies from device to device.
LeMoove is not an emergency service
LeMoove, including the SOS button and alerts, doesn’t replace emergency services and doesn’t contact the police, ambulance or fire department. SOS notifies the people in your groups, who may not see it in time.
If you’re in danger, call your local emergency number (in Brazil, 190 for police, 192 for ambulance or 193 for fire).
Driving report
The score and events in the driving report are estimates based on the phone’s sensors. They’re meant to help people talk about driving. They’re not a technical report or proof of any traffic violation, and they don’t correspond to insurance company ratings.
Never use your phone while driving. Set up what you need before leaving, or ask a passenger.
Chat, calls and content you send
- You’re responsible for the messages, photos, videos, audio, files and links you send.
- You keep the rights to your content and authorize us to store, process and transmit it to the people in the chat, as needed for the Service to work.
- You must not send content that is illegal, violates the rights of others, exposes someone’s intimacy without consent, exploits or endangers children and teenagers, incites violence or discrimination, or contains viruses or malicious code.
- We may remove content and suspend accounts that break these rules, and comply with court orders about content, as permitted by law.
Trackers and devices
- For now, LeMoove only accepts trackers supplied by LeMoove, which come already configured for our servers. The commercial terms of the device, such as price, data SIM and installation, are agreed at the time it’s supplied.
- You may only register devices that are yours or that you’re authorized to use, and install them in vehicles and belongings you’re responsible for.
- Vehicle installation must be done by a qualified person. We’re not responsible for damage caused by improper installation.
- LeMoove doesn’t block or shut down vehicles remotely.
- A tracker depends on power, GPS signal and cellular coverage to work.
- Bluetooth tags record the position of the phone that last saw them, with the app open. They don’t show a real-time position when far from you.
- The number of devices depends on the plan.
Plans, subscriptions and payments
- LeMoove has a Free plan and paid plans (Basic and Complete), monthly or yearly. What each includes is shown before purchase, in the app and on the plans page.
- Subscriptions are sold and billed by the App Store (Apple) or Google Play (Google), in your region’s currency and with its taxes. The price is shown in the store before you confirm.
- Subscriptions renew automatically at the end of each period unless you cancel through the store before renewal.
- Cancellation: done in the settings of the store where you subscribed. Deleting the app or your account doesn’t cancel the subscription. After cancelling, the plan stays active until the end of the period already paid.
- Refunds: refund requests follow Apple’s and Google’s rules and channels. This doesn’t limit the rights the law gives you as a consumer.
- Plan changes: depending on the store, they take effect immediately or at the next renewal. The app shows when the change takes effect.
- Restoring purchases: on a new phone, sign in with the same account and use “Restore Purchases”.
- If there’s a free trial or promotional price, its terms are shown in the store at the time of purchase.
- We may change plan features and prices. Price changes follow the store’s rules, and the store notifies you before charging the new amount.
Prohibited use
In addition to what has already been said, you agree not to:
- use the Service for any illegal purpose or in a way that violates the rights of others;
- try to access data, accounts or systems that aren’t yours, or get around access rules;
- test, probe or exploit vulnerabilities without authorization, or disrupt the Service;
- copy, modify, reverse engineer or try to extract the app’s code, except where the law allows;
- use bots or automated means to access the Service, or overload the servers;
- resell, rent or commercially exploit the Service without our authorization.
Intellectual property
LeMoove, the app, this website, the brand, texts, images and software belong to LeMoove or its licensors and are protected by law. We grant you a personal, limited, non-exclusive, non-transferable and revocable license to use the Service under these Terms. No other rights are transferred.
Third-party services
The Service relies on third-party services, such as the App Store, Google Play, Google Maps, Apple and Google sign-in and the systems’ notification services. Your use of those services is also governed by their own terms and policies, and we’re not responsible for failures or changes in them.
Availability and changes to the Service
We work to keep LeMoove available and running well, but the Service may be interrupted for maintenance, technical failures or causes beyond our control. We may create, change or discontinue features. When a change significantly reduces what you paid for, we’ll give you reasonable notice.
Some older versions of the app may stop working. When that happens, the app asks you to update.
Suspension and termination
- You can stop using LeMoove and delete your account at any time, in Profile, “Delete my account”. What happens to your data is described in the privacy policy.
- We may suspend or close accounts that violate these Terms or the law, that put other people at risk, or when ordered by an authority. When possible and permitted by law, we’ll tell you why.
Responsibilities
You’re responsible for how you use the Service, for the content you send and for respecting the people you share your location with.
To the extent permitted by law, and without limiting the rights guaranteed by consumer protection law, LeMoove is not liable for:
- delays, inaccuracies or failures in location, notices and alerts caused by the factors described in How location works;
- decisions made solely on the basis of information in the app;
- damage caused by using the Service in violation of these Terms, including following people without their consent;
- failures of third-party services, the phone, the network or power;
- content sent by other users.
Changes to these Terms
We may update these Terms. The date of the last update is shown at the top of the page. When a change is significant, we’ll notify you in the app or by email before it takes effect. If you keep using the Service after that, you agree to the new version. If you don’t agree, you can delete your account.
Governing law and jurisdiction
These Terms are governed by the laws of the Federative Republic of Brazil. Any dispute related to them may be brought in the courts of the consumer’s place of residence, as provided by Brazilian consumer protection law.
Before going to court, we suggest talking to us: most problems are solved through support.
